Terms of Service

1. Acceptance of Terms

By accessing or using FedSiteReady ("Platform"), operated by B A Construction, a California-licensed general contractor (CA GC #1021495), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Platform Description

FedSiteReady is a marketplace that connects general contractors ("GCs") with credentialed construction workers ("Workers") for federal, military, state, and public works projects. The Platform facilitates introductions, credential verification, booking, and payment processing.

3. User Accounts

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current, and complete information during registration.

4. User Roles

Workers: May create free profiles, upload certifications and insurance documentation, set hourly rates, manage availability, and receive booking requests from GCs.

General Contractors: May search for workers, view verified credentials, send booking requests, and make payments through the Platform.

5. Credential Verification

FedSiteReady manually reviews uploaded credentials but does not guarantee the accuracy, validity, or completeness of any certification, license, or insurance document. GCs are responsible for conducting their own due diligence before engaging any worker.

6. Booking and Payment

GCs pay a 12% platform booking fee on top of the worker's hourly rate. Payments are processed through Stripe. Workers receive their labor rate directly via Stripe Connect. FedSiteReady retains the 12% booking fee. All payments are final unless otherwise agreed upon by both parties.

7. Non-Circumvention

Workers and GCs introduced through FedSiteReady agree to conduct all transactions through the Platform for a period of twelve (12) months following their initial introduction. Direct engagement outside the Platform during this period constitutes a breach of these Terms and may result in account termination and a circumvention fee equal to the Platform's booking fee on the estimated engagement value.

8. Independent Contractor Status

Workers listed on FedSiteReady are independent contractors, not employees of FedSiteReady or B A Construction. FedSiteReady does not control the manner, method, or means by which workers perform their work. Workers are responsible for their own taxes, insurance, and compliance with applicable laws.

9. Insurance and Liability

Workers are encouraged to maintain their own General Liability insurance, Workers Compensation or Occupational Accident policy, and other applicable coverage. FedSiteReady verifies uploaded insurance documents but does not provide insurance coverage to workers or GCs. Each party is responsible for their own liability exposure.

10. Prohibited Conduct

Users may not: submit false or misleading credential information; use the Platform for any unlawful purpose; attempt to circumvent Platform fees; harass, threaten, or discriminate against other users; scrape, crawl, or extract data from the Platform; or interfere with Platform operations.

11. Content Ownership

Users retain ownership of content they upload. By uploading content to the Platform, you grant FedSiteReady a non-exclusive, royalty-free license to use, display, and store that content for the purpose of operating the Platform.

12. Termination

FedSiteReady reserves the right to suspend or terminate any account at any time for violation of these Terms or for any other reason at our discretion. Users may delete their accounts at any time by contacting hello@fedsiteready.com.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FEDSITEREADY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

IN NO EVENT SHALL FEDSITEREADY OR B A CONSTRUCTION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

15. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.

16. Changes to Terms

FedSiteReady may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
